Directive 2002/58 of Privacy and Electronic Communications was amended in May 2011. Regulatory bodies in the EU and UK implemented a grace period before beginning enforcement to provide companies time to adjust their policies. That initial year-long grace period has come to a close, and as of May 26, 2012, the Privacy Directive will be enforced by the Information Commissioners Office (ICO).
Though the enforcement period had effectively begun, many companies are still in the dark about what the regulation entails and what they need to do in order to be in compliance. This paper will briefly outline what the Directive is, what you need to do, the consequences for non-compliance, and what the future looks like.
